Three Point Shot – July 2022 | Proskauer Rose LLP

Foge, McKeever LLC, Todd M. Rooney and Eldon S. Thompson (“Plaintiffs” or “Homeowners”) owned Saratoga Gia, a three-year-old Standardbred filly who was stabled on the Meadows Racetrack in Washington County, Pennsylvania. On April 7, 2020, to deal with a minor puncture wound Saratoga Gia obtained an injection of Excede, an extended-release equine antibiotic marketed as a “two dose, one resolution” remedy that was simpler and fewer aggravating on in poor health horses than conventional therapies that may require a 10-day course of non-extended launch antibiotics. On April 11th, a veterinarian administered a second dose of the drug, and subsequently, Saratoga Gia suffered a extreme response; regardless of emergency care, she died at a college equine heart on April 15th.
