Mr. Rosales was discovered unresponsive in his mattress and pronounced lifeless in June 2013, along with his loss of life attributed to sudden cardiac arrest brought on by his use of the Noxipro product, in accordance with courtroom papers.
In 2015, Mr. Rosales’ property and heirs sued CTD for wrongful loss of life and associated claims. Its insurer, Lloyd’s, denied protection based mostly on a DMAA exclusion in its coverage.
A settlement settlement was reached through which CTD agreed to a stipulated judgment of $9 million and assigned to the property its proper to pursue claims towards Lloyd’s, in accordance with courtroom papers.
