•The Steerage is illegal as a result of the USDA premised it on an apparent misreading and misapplication of the Supreme Courtroom’s holding in Bostock v. Clayton County. Bostock expressly disclaimed utility to “different federal or state legal guidelines that prohibit intercourse discrimination” – like Title IX and the Meals and Vitamin Act – and expressly didn’t “prejudge any such questions.”

•The Steerage imposes new – and illegal – regulatory measures on state businesses and operators receiving federal monetary help from the USDA. This can inevitably end in regulatory chaos that threatens important dietary providers to a few of the most weak residents.
